THIS IS A WAIVER AND RELEASE OF LIABILITY, HOLD HARMLESS AND COVENANT NOT TO SUE AGREEMENT. PLEASE READ THOROUGHLY.

The undersigned, in consideration of my dog(s) being allowed to participate in The Healthy Bone’s K9 Adventure Program in my absence state and agree to the following:

1. When this Agreement refers to “my dog” or “my dogs”, it includes all animals named in The Healthy Bone’s Pet Information Disclosure, which I have completed and signed off on electronically for each individual Program participant.

2. I understand that The Healthy Bone, LLC will be providing transportation for my dog(s). I acknowledge that allowing The Healthy Bone, LLC, its officers, directors, members, employees, or agents (collectively the “Indemnified Parties”) to transport my dog(s) involves risks of injury to my animal(s) during transport. I knowingly accept and assume all known and unknown risks in allowing my dog(s) to be transported in order to participate in The Healthy Bone’s K9 Adventure Program.

3. I acknowledge that allowing The Healthy Bone, LLC, its officers, directors, members, employees, or agents (collectively the “Indemnified Parties”) to work with my dog(s) off-leash involves risks of injury to my animal, other persons, my dog(s) and other dogs. The risks include but are not limited to, risks resulting from aggressive dogs, unpredictable behavior and lack of proper training. Additional risks include, but are not limited to: fierce, aggressive, vicious, and dangerous dogs which may be present during a K9 Adventure Program outing; the inexperience or irresponsibility of another dog owner/handler of whom is completely unaffiliated with The Healthy Bone, LLC; the inability to predict a dog’s reaction to sound, movement, objects, persons or other animals, as well as all other circumstances inherent to a dog and/or outdoor activities; dog fights, dog bites; theft or unlawful capture; escape from the designated premises. I further understand that dogs, irrespective of the training and usual past behavior or characteristics, may act or react unpredictably at times based upon instinct or circumstances and that not all hazards and dangers associated with dog activities can be foreseen. I also understand that there are certain inherent risks including the propensity of a dog to behave in dangerous ways. I further understand and assume the risk that not all dogs that my dog may come in to contact with during The Healthy Bone’s K9 Adventure Program (that are in no way associated with the Program) may have been vaccinated for distemper, parvo, or rabies, all of which could result in injury to my dog(s).

4. I acknowledge that injuries could result from accidents or the negligence or carelessness of others including The Healthy Bone, LLC, its officers, directors, members, employees, or agents. I knowingly accept and assume and known and unknown risks in allowing my dog(s) to participate in The Healthy Bone’s K9 Adventure Program, whether specifically identified herein or not.

5. I agree to indemnify and hold harmless The Healthy Bone, LLC, its members, directors, officers, agents, managers, employees (collectively the “Indemnified Parties”) from all current and future, foreseen and unforeseen actions, expenses, judgments, damages, claims, losses or liabilities of any kind, including those arising out of their negligence or carelessness, and including attorney fees incurred and in defending against any of the same, that may arise from or in connection with my dog’s participation in The Healthy Bone’s K9 Adventure Program, including personal injuries or death to/of my dog(s).

6. THIS WAIVER AND RELEASE OF LIABILITY, HOLD HARMLESS AND COVENENT NOT TO SUE AGREEMENT SHALL BE EFFECTIVE EVEN IF THE INJURY, DEATH, CLAIM, LOSS OR DAMAGE RESULTS FROM THE NEGLIGENCE OF THE HEALTHY BONE, LLC OR ANOTHER INDEMNIFIED PARTY.

7. I hereby acknowledge that the Indemnified Parties have no obligation to provide medical care for my animals and have not undertaken responsibility to do so; however, I consent to emergency medical treatment for my dog, as set forth in The Healthy Bone’s Veterinary Release Agreement and Pet Information Disclosure, both of which I have completed and signed off on with my electronic signature and submitted online, via The Healthy Bone’s website.

8. This agreement is executed without reliance upon any promise, inducement, statement or representation by the entity and or person released or their representatives or attorneys.

9. The terms of this Agreement shall serve as a complete waiver and release of liability, hold harmless and covenant not the sue agreement and EXPRESS assumption of all risks. I shall be solely responsible for my dog’s safety and well-being, and for all expenses that arise directly or indirectly from my dog’s participation in The Healthy Bone’s K9 Adventure Program.

I acknowledge that I have been afforded the opportunity to consult with legal counsel regarding the terms and conditions of this Agreement. I acknowledge that I have read the entire Agreement, that the terms of the Agreement are clear to me and there are no other understandings or agreements other than as set out above, and that I voluntarily consent to all of the Agreement’s terms and provisions.

READ THIS WAIVER AND RELEASE OF LIABILITY, HOLD HARMLESS AND COVENANT NOT TO SUE AGREEMENT CAREFULLY, ASK ANY QUESTIONS BEFORE SIGNING, AND RETAIN A COPY. YOUR SIGNATURE ACKNOWLEDGES THAT YOU FULLY UNDERSTAND THE TERMS OF THE AGREEMENT, BELIEVE IT IS FAIR AND REASONABLE, AND AGREE TO ITS TERMS. DO NOT SIGN IF YOU DO NOT UNDERSTAND OR DO NOT AGREE WITH ITS TERMS. YOUR SIGNATURE CONFIRMS THAT YOU ARE ALSO NOT AWARE OF ANY INCIDENTS IN WHICH YOUR DOG HAS SHOWN AGGRESSIVE, FIGHTING, OR BITING BEHAVIOR TOWARDS OTHER ANIMALS OR PEOPLE.
